AboutOfficeSpace.org (Site) is a service owned and operated by InterData Access Corporation, in association with Diamond Realty (IDAC). By accessing the Site or by utilizing any of the services or features appearing on the Site, including but not limited to placing or viewing a listing, corresponding via e-mail, updating or modifying your listing, you hereby accept and agree to the following Terms of Use:

a) that access to and use of the Site, including the services and features therein, are solely at your own risk. If you are dissatisfied with any of the Site's content or Terms of Use, your sole remedy is to discontinue access to and use of the Site. You further agree that none of IDAC, its owners or affiliates, nor the web designer(s), internet hosting service, sponsors, partners or advertisers of the Site will be liable for any direct, indirect, incidental, consequential, or punitive damages arising out of access to or use of the Site; and that you understand that all of the information appearing on the Site is provided "as is" without warranty of any kind, either expressed or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose or non-infringement.

b) that all your listing information, including, but not limited to, company name, address, contact information, including telephone and fax numbers, e-mail and web addresses, etc., excluding login username and password, are all available for public viewing and that IDAC reserves the right to disclose such information as required by law and to edit, refuse to post or delete any message, listing or any other content that the Site receives that IDAC, in its sole discretion, deems objectionable.

c) that by posting a listing on our site, you are giving your permission and agreeing to be contacted by us and anyone else who may publicly view your listing. You may delete your listing at any time sending us an email to info@aboutofficespace.org and providing your listing information and requesting deletion. The email address on the notice must agree with the email registered for the listing.

d) that IDAC does not guarantee the accuracy of the listings or other information appearing on the Site, and such information is subject to errors, omissions, changes in price, prior sales, rentals, and withdrawals without notice. Furthermore, any listing appearing on the Site is for informational purposes only and does not constitute an offer to sell or lease.

e) that IDAC does not warrant or make any representations of any kind or nature with respect to the information contained in the Site, and that you are solely responsible for compliance with any applicable real estate laws or other applicable state or federal regulations. IDAC urges you to seek legal counsel before entering into any lease or real estate agreement. It is your responsibility to independently verify any statement made within any listing and to consult with engineering, architectural or other professionals as may be appropriate to determine the condition and suitability of any particular property for the purpose for which you intend to use it.

f) that by submitting our listing, we understand and agree that IDAC by providing this service, does not guarantee performance, or service and will make its best effort to ensure access to the web site by authorized ISP's or other acceptable conventions, but does not guarantee that the web site will be available at all times, nor does it guarantee the appearance of the web site by individual browsers. There are times of server maintenance, problems with the Internet, vagaries of electronics, quirks of software and possible heavy traffic that can influence access times and performance beyond the control of IDAC. IDAC takes no responsibility for these occurrences. Any problems experienced with using this service should be reported at once to the webmaster.

g) that neither IDAC nor its owners, partners or affiliates shall be responsible for any damage caused to your computer, or for viruses which may affect your computer as a result of accessing the Site or utilizing any of the services or features which appear therein.

h) that IDAC does not warrant or make any representations of any kind or nature as to the following: (a) the character or credit worthiness of those who (i) browse and/or utilize the listings appearing on the Site; that (ii) place listings on our Site; or (iii) that use our e-mail and/or Express Entry forms; or (b) the suitability for any particular purpose, compliance with applicable zoning, environmental or any other laws, quality of space and/or services to be provided pursuant to listings appearing on our Site.

i) that neither IDAC nor its owners, partners or affiliates shall be responsible for content appearing on third party sites which are linked to the Site or for any incentives that may be offered by anyone other than IDAC in connection with any listing; and you agree to look solely to the third party offering such incentive and hold harmless and release IDAC from any liability whatsoever in connection with any third party content or incentives.

j) that you agree to the jurisdiction and venue of all matters relating to this Agreement will be vested exclusively in the federal, state and local courts within the State of Georgia, without regard to choice of law provisions.

k) that IDAC may revise the terms and conditions of this Agreement at any time, and you shall be bound by such revisions and you agree to indemnify, defend and hold harmless IDAC, its owners, partners, sponsors and affiliates against any and all claims, damages, costs or other expenses arising out of your violation of any of the terms and conditions herein.

l) that AboutOfficeSpace.org and the AboutOfficeSpace.org logo are trademarks of InterData Access Corporation and that InterData Access Corporation owns all rights in and to the Site, including all of the information therein, or has obtained the proper licenses to use certain material; and except for the limited, personal, noncommercial, revocable right to view the copyrighted and trademarked content appearing on the Site, no expressed or implied license is otherwise granted to you in connection with use of the Site. Any unauthorized use of the Site or a copy thereof, in whole or in part, is prohibited. You are solely responsible for complying with all applicable U.S. and international intellectual property laws in connection with the Site and its content.

m) that this agreement is effective until terminated by IDAC, which termination may occur at any time without notice if IDAC believes in its full discretion that you have violated any of the terms herein; and upon termination of this Agreement with you that you will no longer be authorized to access the Site services or features therein upon such termination.
